The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) passed as part of the federal government’s last omnibus spending bill, and with that came significant amendments to the Federal Food, Drug and Cosmetic Act (FDCA). 

    New and expanded regulatory requirements for cosmetics include facility registration, product listing and safety substantiation. Also new are adverse event reporting requirements, labeling obligations and fresh recall authority through FDA. For companies manufacturing and marketing cosmetic products in the U.S., the time to prepare to meet these requirements is now, as most of the new cosmetic regulations will take effect on Dec. 29, 2023.
